Lasting Powers of Attorney

A Lasting Power of Attorney allows an individual to appoint someone to manage their affairs if they lose capacity to do so. This can cover dealing with their property and affairs and/or their personal welfare.

If an individual loses their mental capacity without having made a Lasting Power of Attorney then an application to the Court of Protection for an order to appoint a Deputy to act on their behalf will be necessary but the powers they are granted are likely to be more restricted.
